In Vinnytsia region on peculiarities of procurement of natural gas and services distribution from 01.01.2016 years (+photo)
In connection with the entry into force of the Law of Ukraine on 09.04.2015 No. 329-VIII "On natural gas market" and regulations Mkreku 30.09.2015, No. 2496 "About approval of rules of natural gas supply",the Ministry of economic development and trade of Ukraine provided and on the official website issued a clarification regarding the procurement of natural gas and services distribution. According to the regulatory framework all customers of natural gas are domestic, have the right to freely choose their supplier of natural gas, which actually means the impossibility of applying paragraph 2 of part 2 of article 39 (lack of competition) of the law of Ukraine of 10 April 2014 No. 1197-VII "On state procurement". The supplier shall be obtained in accordance with the established procedure the license for implementation of this type of economic activity. In addition, the area of implementation of economic activity on supply of natural gas at regulated tariffs with indication of the list of administrative-territorial units shall be approved by the relevant decision NCRCP on the issuance of the corresponding license for each supplier. In relation to the distribution of natural gas (transportation of gas through main and distribution pipelines), note that the agreement regarding the distribution of natural gas may be concluded solely with the subject of natural monopoly within a specified area, in accordance with the rates established by the resolution from 29.12.2015 NCRCP No. 3159 "establishing common tariff for transportation of natural gas transportation tariffs of natural gas transmission and distribution pipelines", from 29.12.2015 No. 3160 "On establishing the tariff for distribution services of natural gas for JSC "vinnitsagaz", and in accordance with a Standard form contract distribution of natural gas, approved by the resolution from 30.09.2015 NCRCP No. 2498 (Appendix 2) by applying the appropriate procurement procedure, if the annual cost of such services is equal to or exceeds 200 thousand UAH, or by concluding direct contract with the monopolist, if the value is less than 200 thousand UAH. Is this Contract by signing the Declaration of accession (Annex 3). Note that a contract for the supply of natural gas may be contracted with any entity that has received in accordance with the established procedure the license for implementation of activity on supply of natural gas and subject to the procedure of competitive bidding in accordance with the provisions of the law of Ukraine "On state procurement". It should be noted that according to the Rules of natural gas supply (the Regulation NCRCP from 30.09.2015, No. 2496) the basis for the contract for the supply of natural gas is the consumer, the object of which is connected to the gas distribution system, a contract for distribution of natural gas, concluded in the established order between the consumer and the operator of the gas distribution system.
