Chernivtsi: the Conditions for women's entry to a retirement pension on preferential terms in

Paragraph 2 of the Concluding provisions of the Law of Ukraine "On compulsory state pension insurance" provides that before the introduction of pension through professional and corporate funds, the persons who have worked or are working at positions which grant the right, in particular: the appointment of old-age pensions on preferential terms, pensions are fixed according to the norms of this Law in case of retirement age and seniority, provided by Law of Ukraine "On pension provision". According to the provisions of clause b of article 13 of the Law of Ukraine "On pension provision" the right to pension on age on preferential terms have workers in full employment in jobs with harmful and heavy working conditions List No. 2 productions, works, professions, positions and indicators approved by the Cabinet of Ministers of Ukraine, and by results of certification of workplaces-after reaching 55 years of age and work experience, particularly in women at least 25 years, of which at least 10 years on the specified works. To reaching the age specified in paragraph one of this paragraph, the right to pension on age on preferential terms have women born in 1970 and older after they reach this age: – 50 years – March 31, 1965, inclusive; – 50 years 6 months – 1 April 1965 to 30 September 1965; – 51 years old – from 1 October 1965 to 31 March 1966; – 51 years 6 months – 1 April 1966-30 September 1966; – 52 years – from 1 October 1966 to 31 March 1967; – 52 years 6 months – 1 April 1967 to 30 September 1967; 53 years – 1 October 1967-31 March 1968; – 53 years 6 months – from 1 April 1968 to 30 September 1968; – 54 – from 1 October 1968 to 31 March 1969; 54 years 6 months – from 1 April 1969 to 30 September 1969; – 55 years – from 1 October 1969 to 31 December 1970. In the absence of the required insurance experience (25 years), in the period up to April 1, 2024 old-age pension on preferential terms is assigned in the presence of work experience, particularly in women: from 1 April 2016 to 31 March 2017 – at least 21 years old; from 1 April 2017 to 31 March 2018 – at least 21 years old 6 months; from 1 April 2018 to 31 March 2019 – at least 22 years old; from 1 April 2019 to 31 March 2020 – at least 22 years 6 months; from 1 April 2020 to 31 March 2021 – at least 23 years of age; from 1 April 2021 to 31 March 2022 – at least 23 years 6 months; from 1 April 2022 to 31 March 2023 – at least 24 years old; from 1 April 2023 to 31 March 2024 – at least 24 years 6 months. Therefore, the mandatory provisions for determining the right to pension on age on favorable terms is : – achievements specified by the legislation of retirement age; – availability of necessary grace period (10 years); – availability of necessary insurance on the date of application. Women who do not have the necessary grace of experience, but having at least half of this experience (5 years), retirement age on favorable terms with a reduction of the pension age established by article 26 of the Law of Ukraine "On compulsory state pension insurance" (60 years), namely: for women, the retirement age is reduced by 1 year for every 2 years of work with harmful and heavy working conditions. The decrease in the retirement age for women is also used in the period of increasing the age of retirement on December 31, 2021. Please note that according to the decree of the Cabinet of Ministers of Ukraine dated 01.08.1992 ¹442 "About the order of carrying out of certification of workplaces on working conditions" work periods after 21.08.1992 counted in the subsidized work experience on the results of certification of working places on working conditions.
