Rivne local Prosecutor's office to protect the interests of the state and local communities presented to the court the claim about recognition void the prisoner between the city Council and construction companies the additional agreement on share participation in construction of residential quarter. We are talking about a complex of residential development along with entertainment and shopping center in the Kostroma and Gagarin streets in the city. It is established that under the terms of contractual obligations after completion of construction provided the space allocation, according to which territorial bulk of the city receives 4.5% of the total living space in the newly constructed object, which is roughly 2.5 thousand sq m cost about 40 million UAH. However, pursuant to an agreement in subsequent additional agreements the parties have made changes to the basic contract, under which developers receive 100% of residential and non-residential premises and the town Council – no profit. Due to the fact that this transaction is contrary to the requirements of Laws of Ukraine "On regulation of urban development", "On investment activity", as well as the interests of territorial communities, Rivne local Prosecutor's office took measures of Executive nature relating to the annulment. Currently, the prosecution claim is pending at the economic court of Rivne region.
