In Vinnytsia region Prosecutor's office takes measures for protection of state interests in the sphere of land relations
the Prosecutor's office of Vinnytsia region revealed that land use and communal ownership of more than 1 hectare without payment of rent. It is established that one of the sub'objects of management in 2009 within the town of Tyvriv district, hnivan ' purchased the property in non-residential buildings and structures integral property complex, situated on a land area of 1.03 hectares. The property complex used for entrepreneurial activities for the construction of residential and non-residential buildings, however, the company the lease contract of the land plot with Gnivan city Council had not concluded, with the result that territorial community of the city suffered damage in SV'connection with poterjannom payment for the land. According to article 206 of the Land code of Ukraine the use of land in Ukraine is paid. According to the Procedure of determination and compensation of losses to landowners and land users approved by resolution of the Cabinet of Ministers of Ukraine, land owners and land users shall be reimbursed for damages caused by withdrawal (redemption) and the temporary occupation of land plots and poterjannom incomes in SV’connection with the temporary use of land. The losses are determined by the commissions set up by Kyiv and Sevastopol municipal, district state administrations or Executive committees of city (cities of regional importance) councils. At the initiative of the Prosecutor's office Tyvrovsky regional state administration carried out the calculation of the losses caused by the enterprise Nanseki city Council at the time of use of the land, which amounted to 242 thousand UAH. Since these losses the company is not voluntarily paid, the prosecution is in the interests of the state in the face of Gnivan city Council declared a lawsuit to recover them in court.
