Zakarpattya district administrative court fully supported the position of the local Prosecutor's office of Uzhgorod, to satisfy the claims of which the Prosecutor's office appealed against the decision of Uzhgorod city Council. We are talking about the decision, which the city Council, contrary to the requirements of the land and town planning legislation, illegally disposed of lands with a total area of nearly 4 hectares and cost more than 78 million UAH and transferred them to permanent use to the Department of education. So, the basis for the appeal the local Prosecutor's office to the court was the fact that placing on these land plots of the educational establishment not provided by the General plan of the city, and therefore the granting of permission for its placement without having to make and approve changes in the master plan contradicts the current legislation of Ukraine. In particular, according to the provisions of article 17 of the Law of Ukraine «On regulation of urban development" (as amended at the time of making controversial decisions), the General plan of the settlement is the main form of urban planning documentation at the local level, designed to justify a long-term strategy planning and development of the territory of the settlement. The net's capacious part of the General plan of the settlement is the plan for the land-economic device of this settlement. The General plan of the settlement shall be developed and approved in the interests of the relevant territorial community including government, public and private interests. Thus, the Prosecutor's office adopted effective measures aimed at the sustainable development (development) of the city in compliance with the requirements of the current legislation taking into account the interests of the territorial community and the state on the rational use of land.
