Through the intervention of the Prosecutor's office of Rivne returned to the municipal property of premises of the educational institution value of 342 thousand UAH
By results of consideration of the appeal of the Prosecutor's office of Rivne region the Highest economic court of Ukraine 04.07.2017 confirmed the legality of the decision of the court of 1 instance, ordered the owner to vacate and return a secondary school part of the premises with an area of 145, 4 sq. m value of 342 thousand UAH. We are talking about non-residential premises building Specialized secondary school I-III stages No. 29 in the town of Khmelnitsky, which the tenant (natural person-entrepreneur) used contrary to the requirements of the law of Ukraine "On education" is not for educational purposes. On the revealed violations of the legislation responded to local prosecutors, claiming in court the claim about cancellation between the local government of the lease of the building and returning it to communal ownership. The claim of the prosecution was fully supported by the decision of the court of 1 instance, however, later on the appeal of the Respondent (tenant) was cancelled by the Rivne appellate economic court. To protect the interests of the state in the field of child protection Prosecutor's office of Rivne region appealed the said unlawful decision of the court of appeal. It, by results of consideration of cassation the Supreme economic court of Ukraine overturned and upheld the decision of the court of 1 instance, than confirmed the legality of the claim of the prosecution on the return of the school premises with a value of 342 thousand UAH. Additionally: Since the beginning of 2017, the bodies of Prosecutor's office of the Rovno region initiated the termination in court illegal use of premises of educational institutions with a total area of 1750 sq. m and cost over 1 million.
