In the Transcarpathian region initiated criminal proceedings on the fact of abuse of authority and forgery by employees of the Department of education RSA Khust
Khust Interdistrict Prosecutor's office initiated criminal proceedings against officials of the Committee on competitive bidding of the Department of education RSA Khust on the fact of abuse of power or position and official forgery (part 2 of article 364 and part 2 St. 366 criminal code of Ukraine). It is established that in 2015 the Committee on competitive bidding of the Department of education of Khust DSA held two tender procedure for purchase of brown coal (lignite), a mass of 1360 tons and a weight of 200 tons, in both of which involved the same LLC. Requirements documentation both of the above competitive bidding provided for the provision by the bidder certificate of coal quality, which must meet certain requirements specified in the bidding documents. For participation in both the above specified auction LLC filed a similar quality certificates that do not meet the requirements of the tender documentation. However, in the first case, the company was lawfully denied participation in the procurement procedure. However, in another contest, despite the inconsistency with the requirements of the tender documentats, the participant admitted to the competition which he subsequently won, and entered into with the Department of education RSA Khust agreement for the supply of brown coal in the amount of 300 thousand UAH. Thus, officials of the tender Committee of the Department worlds of Khust RSA, contrary to the requirements of article 3, paragraph 3 of part 1 of article 29, part 1 of article 30 of the law of Ukraine «On state procurement”, abusing his official position, for the purpose of obtaining unlawful benefit for a specified LLC (in the provision of benefits specified the LLC as a bidder to another party, followed by a win in the last auction), caused to the interests of the state represented by the Department of education RSA Khust serious consequences (material damage) for a total amount of 300 thousand UAH. The sanction of part 2 of article 366 UK of Ukraine (forgery) provides for the punishment by deprivation of liberty for a period from 2 to 5 years with deprivation of the right to occupy certain positions or engage in certain activities for a term up to 3 years with a fine from 250 to 750 non-taxable minimum incomes of citizens; part 2 of article 364 of the criminal code of Ukraine (abuse of power or official position) provides for punishment by deprivation of liberty for a period from 3 to 6 years with deprivation of the right to occupy certain positions or engage in certain activities for a term up to 3 years with a fine from 500 to 1000 non-taxable minimum incomes of citizens.
