Information office National service of mediation and reconciliation on the state of socio-labour relations on the territory of Ternopil region in 2015

Under the Laws of Ukraine "On local state administrations", "On the procedure for settling collective labor disputes (conflicts)", the Department of National service of mediation and reconciliation in the Ternopil region in cooperation with the Ternopil oblast state administration carries out measures for promoting the resolution of collective labor disputes, conflict situations, develop coordinated proposals for the development of socioeconomic and labour relations, reduction of social tension, timely resolution of employment disputes or other legal means to ensure social stability in the region, the implementation of constitutional rights and guarantees of workers. In accordance with the powers of a branch of the Sena in the Ternopil region during 2015 contributed to the decision 7 of the collective labour dispute at the production level, the participants were 310 people (72.4 per cent from the average recorded number of full-time employees of accounting firms), with 35 the requirements of the employees which related to implementation of the collective contract, agreements or their individual provisions - 32 and non-compliance with requirements of labor legislation - 3. With the assistance of the branch of the Sena in the course of conducting conciliation procedures agreed 6 collective labour disputes and fulfilled requirements of 34 employees. Measures were taken to prevent the emergence of a collective labour dispute resolution 24 (4 at the territorial level and 20 at the manufacturing level) cases of destabilization of the state of socio-labour relations on the 175 companies in the region with 24 destabilizing factors (relative to the conclusion or modification of collective agreement, agreements, - 3, not meeting the requirements of the labor legislation – 21) with the total number of full-time employees – 5450. The main factors that led to the complication of the state of socio-labour relations at enterprises of the region were: the arrears of wages trevisosystem of the collective agreement, agreements. In particular, measures were taken for settlement of cases of destabilization: at the territorial level: - 4 cases in the field of education; at the production level in: - research and development - 1; - water supply; Sewerage, waste management - 2; - processing industry - 3; - air transport - 1; - health care and social assistance 2; -build – 11. As a result of the work of the office of Sena settled the state of socio-labour relations on 132 enterprises of the region with the total number of full-time employees – 3963 people and eliminated 23 factors of destabilization with the repaid debts on wages, which was a factor of destabilization 7 million 104 thousand UAH. During the reporting period, the office of Sena worked with companies where conflicts are latent in nature. In the database the contentious area businesses were 21 enterprises, of which 6 enterprises of the state of socio-labour relations are regulated, on a 14 - state of socio-labour relations registered office Sena to prevent the emergence of a collective labour dispute. Performing a basic task defined by the Law of Ukraine "On the procedure for settling collective labor disputes (conflicts)", the Sena will continue to carry out activities in the settlement process the state of social-labour relations to prevent the occurrence of collective labor disputes, to assist in the resolution of collective labour disputes, improve the level of legal culture of the parties of social dialogue.
