In Vinnytsia region Prosecutor's office defended the rights of Chernobyl
As previously reported, the Prosecutor's office of Vinnytsia region in the courts protected the interests of individuals affected by the Chernobyl disaster. It is established that the Executive Committee Kalinowski the city Council has provided free one-bedroom apartment a private entrepreneur and his family, at a time when the provision of specified housing had the right of elderly persons who suffered as a result of the Chernobyl disaster and in need of social protection by the state in connection’connection with disabilities. Prosecutors went to court with the corresponding claim, defending the violated housing rights of those individuals. The decision of the district court demands the Prosecutor about recognition illegal and cancellation of decisions of the Executive Committee Kalinowski the city Council, warrant the premises, the agreement of housing hiring and eviction of persons illegally granted a two-bedroom apartment in Kalynivka satisfied. On the appeal one of the defendants the decision of the court of 1 instance is cancelled and the claim of the district Prosecutor refused. The area Prosecutor's office on the decision of the appellate court filed appeal. The Supreme specialized court of Ukraine for civil and criminal cases partially upheld the cassation appeal of the Deputy Prosecutor of Vinnytsia region and cancelled the decision of appellate court of Vinnytsia region from 20.04.2015, the case was transferred for reconsideration in the court of appeal. The Prosecutor during a retrial in the appellate court proved that the registration of kartini accounting and issuance of orders to individuals was carried out with violations of requirements of the law. Definition of appellate court of Vinnytsia region the appeal complaint of one of the defendants are dismissed, the decision of the court of first instance that requirements of the Prosecutor satisfied in this case, left unchanged.
