Officials of Uzhgorod city Council,abusing official position, provided the participants of warfare in Afghanistan, the resolution on preparation of documents for privatization of land,and subsequently denied approval of land development projects - office
the Prosecutor of the Transcarpathian region began criminal proceedings concerning officials of Uzhgorod city Council, Department of land use, management of town planning and architecture of Uzhgorod city Council for part 2 St. 364 criminal code of Ukraine (abuse of power or official position, entailed heavy consequences). It is now established that the specified officials in April of 2015, abusing official position, deliberately, with the aim of creating a positive image of officials of local self-government, contrary to the interests of the service, in violation of the requirements of article 20, 39 of the Land code of Ukraine, authentically knowing about the violation of the established procedure of use of lands of residential and public buildings, the presence within the construction area protective zones and treatment facilities, has prepared and adopted a decision which gave permission to the combatants in Afghanistan and other military conflicts on the development of a land management project on allotment of land plots for construction and maintenance of residential houses in the streets of Zagorsk. So that’found that for the adoption of the above decisions of official persons of Uzhgorod city Council in accordance with the requirements of articles 39, 40 of the Land code of Ukraine, Law of Ukraine «On regulation of city planning activity" it was necessary to produce and adopt appropriate planning documentation - a detailed plan of the territory that the latter was not done. Thus, despite the prior granting of permission to develop the project of land allocation for urban needs, officials of the Uzhgorod city Council withdrew from performing their duties’responsibilities for regulation of land relations and appropriate powers in the field of urban planning, in flagrant disregard of the requirements of articles 186, 186-1 of the Land code of Ukraine, Law of Ukraine «On the status of war veterans, guarantees of their social protection", denied approval of land development projects, for which the combatants paid cash land surveying organizations. As a result of illegal actions of officials of Uzhgorod city Council caused grave consequences, which resulted in gross violation of the legal status of war veterans. The pre-trial investigation in the specified criminal proceedings is entrusted to the local Prosecutor's office of Uzhgorod and is on control of Prosecutor of the region.
