With the aim of improving the procedure of state registration of proprietary rights to immovable property was adopted the Law of Ukraine “On amendments to the Law of Ukraine “On state registration of proprietary rights to immovable property and their encumbrances”. This Law, which entered into force on 1 January 2016, provided the following changes: State registration of ownership and other real rights is carried out in a period not exceeding 5 working days. The documents issued by results of consideration of applications in the sphere of state registration of rights, the applicant may receive both electronically and in paper form. The documents received in electronic and paper form, will have the same legal force. There is no issue of certificates of title to real property, in contrast to legislation in force prior to 1 January 2016. Information from the State register of rights at the request of the applicant may be provided in paper form subject to the state registration for which the registration fee paid, by printing it using software tools for maintaining the State register of the rights to the sheets of paper of A4 size (210 x 297 mm) without the use of special forms, affixing the stamp and signature of the state Registrar. That is why information from the State register of rights are issued without the use of special forms, affixing signature and seal. The decision, actions or inactivity of the state Registrar, subject state registration of rights may be appealed to the Ministry of justice of Ukraine, its territorial authorities or the courts. From the date of entry into force of this Law notaries authorized state registrars of rights to immovable property and may carry out state registration of rights to immovable property and their encumbrances without the Commission of notarial actions in respect of such property.
