Chernivtsi: Legal employment – the guarantee of social protection of employees

the Constitution of Ukraine States that every citizen has the right to work, which includes the opportunity to earn his living by work which he freely chooses or on which freely agrees. Obligatory state social insurance of guaranteed social protection of the citizens through insurance premiums (from 01.01.2011 – single social contribution). Unfortunately, the activities of a certain category of employers is built on the shadow schemes using labour without proper registration and payment "in envelope", which most often occurs in the sphere of temporary accommodation and catering (hotels and restaurants), services and trade. The danger of the shadow employment and shadow salaries, is not so much that the budget receives less money in tax revenues and Pension Fund contributions, but also in the fact that citizens at risk in the first case, to lose the right to pension, and in the second part of it, because its calculation takes into account the size of the salary. The workers who are offered a job without an employment contract with a payment "in envelope", before agreeing on the proposal, it is worth considering the advantages of formal employment, among which: * paid wage premiums – is a worthy pension in the future insurance payments in connection with temporary disability (sick pay, vacation and maternity leave), in connection with the occurrence of an industrial accident, due to the onset of unemployment; * the opportunity to realize their abilities to productive and creative work, to Express themselves, to secure for itself a positive reputation, as well as motivation to improve skills and career prospects; * guarantee by the employer for the observance of labor legislation: establishing the duration of working time, paid time off, proper working conditions in the workplace, addressing issues of labour protection, etc.; * the ability to protect legal rights and interests of workers and labor disputes arising between the employee and the employer, in court. There are advantages to using legal work and for employers: * formally employed workers – a close-knit, harmonious group of permanent, reliable, creative and proactive personalities, in which all workers will devote its efforts to the improvement of the final result and increased revenue; * warranty material liability of the employee, which includes customer service cash, inventory and etc.; * labour discipline; * the opportunity in court to defend their violated rights and legitimate interests; * the opportunity to use the mechanism of compensation of the costs of the employer on payment of single fee for obligatory state social insurance for every formally employed worker. The formalization of employment in the first place, a guarantee of social protection of employees, staffing stability and efficient work of all participants of labour process to achieve a positive result. However, for an employer – this is a positive image and reputation of a reliable partner that is key to the prosperity of business and their profits. This was reported in the Chernivtsi city Council
