Lviv appellate commercial court satisfied the appeal complaint of Prosecutor's office of area and canceled the illegal decision of the economic court of the Transcarpathian region from 14.01.14 years, by which the claim of LLC «Carpathian ore company’ satisfaction. Therefore, Zobov’was OOO «Zakarpatpolimetally" transfer of LLC «Carpathian ore company" old tailings – accumulated in the process of gold mining, not processed in full Nadra (tailing dumps) located on the site of the defendant (LLC Zakarpatpolimetally) and are Muravskaja Deposit in the amount of 234 580 m³ or 281496 t, the carrying amount over 29 mln. The court of appeal the claim was dismissed in full. Now there is reason of breach by court the question on turn of execution of the above decision of the court of first instance. As previously reported, the specified unlawful decision by the Prosecutor of the Transcarpathian region identified during continuous monitoring of court decisions that could cause significant economic losses to the state. In particular, the court, in determining whether the inclusion of minerals Muravskaja deposits of gold and polymetallic ores mined JSC «Zakarpatpolimetally" to the State Fund of mineral deposits is not attracted to participate in the proceedings, the Ministry of ecology and natural resources of Ukraine and State service of Geology and mineral resources of Ukraine. Besides, the court wrongfully considered and satisfied the claim of the plaintiff on the transfer of minerals, as the order of the transfer of such deposits regulated at the legislative level and the powers to transfer is vested in the interdepartmental Committee created by the Executive authority. Also, the court has not taken into account the fact that the right to use subsoil makes sure the act of providing mountain branch, in the LLC ’s Carpathian ore company" is missing.
