Volhynia: the regional Prosecutor's office appealed the decision of the court of acquittal of persons who organized illegal business in the underground casino
the Prosecutor's office supported the state prosecution in criminal proceedings regarding n’five individuals who were accused of gambling activity, committed by an organized group (a criminal offense under part 3 article 28 – part 1 of article 203-2 of the Criminal code of Ukraine). Sentence Kovel district court a month ago, three people for a profit in underground casinos were responsible for organizing, conducting and enabling players to play poker and found guilty of occupation by a gaming. Against two others who were accused of organizing classes in such illegal activity, the court accepted the verdict of not guilty in connection’connection with the lack of evidence of their guilt in the Commission of a crime. Disagreeing with the decision of the court of first instance, the regional Prosecutor's office appealed in the appellate procedure on the grounds of discrepancy of conclusions of court to actual circumstances of production, improper application of the law of Ukraine on criminal liability, m’quality of the appointed punishment in connection’connection with essential violation of the criminal procedure law. Prosecutors in appellate court will be to insist on the inevitability of punishment of all the accused for the crime.
