Transcarpathian district administrative court opened proceedings on the suit of the Prosecutor's office of area about a recognition illegal inactivity of Mukachevo border detachment (military unit 2142) concerning the registration rights of use land plots within the border strip along the state border of Ukraine approximate total area of 617 ha for the purpose of their formation as about’object of civil rights worth more than 16 million UAH. The basis for the appeal in court with the lawsuit cases of property and use of land along the border strip. Prosecutors the facts of granting land border strip along the border to private ownership and use, which is a flagrant violation of the requirements of article 84 of the Land code of Ukraine, article 3 of the Law of Ukraine «On the use of land defense", other legislative and subordinate normative acts. This situation arose mainly due to prolonged inactivity of officials of bodies of protection of the state border on the appropriate design of land use on ground defense. It gave and still gives the opportunity to certain officers of local governments and Derzeitiger ability to manipulate the management of state-owned land due to the lack of legal documents. However, the authorities of the state border service in the face of Mukachevo border detachment did not use and do not use effective measures on registration of documents for the right to use the land frontier, which certainly creates conditions for unlawful disposal of local governments and state government land within the border strip and the adjacent lands and endanger the smooth execution of functions on protection of state border. Therefore, one of the requirements in the claim of the regional Prosecutor's office has commitments’liabilities of the specified body of the state border service to take measures, stipulated by articles 92, 116, 123, 125, 126 of the Land code of Ukraine for the purpose of acquiring rights to use land plots within the border strip along the border of Ukraine approximate total area of 617 hectares, worth over 16 million USD. and registration of rights on them.
