Chernivtsi: I receive a pension in Ukraine in 2010. In the near future plan on moving to a permanent residence in Moldova. How I will be paid the Ukrainian pension?
Pension provision of citizens of Ukraine and citizens of the Republic of Moldova and members of their families is regulated by the Agreement between the Government of Ukraine and the Government of the Republic of Moldova on guarantees of citizens ' rights in the field of pension provision, which operates from 19.11.1996. Article 5 of the Agreement provided that provision of pensions of citizens of Ukraine and citizens of the Republic of Moldova is carried out according to the legislation of the state in whose territory they reside. In accordance with part 2 of article 5 of this Agreement during the resettlement of the pensioner from the territory of one state on the territory of another for permanent residence, payment of a pension at the previous place of residence ceases. At the new place of residence of the pensioner the pension is appointed since a month following after month of the termination of payment of pension at the previous place of residence, but not more than 6 months prior to the month of registration or obtain a residence permit. If appointed at the previous place of residence, type of pension not provided by the legislation of another country, the payment of pensions is made by the state, which was given a pension, before the emergence of the right to a pension under the laws of the state of residence. Thus, in the case of resettlement on the territory of Moldova for payment of a pension in Ukraine will stop. According to article 7 of the Agreement, pension provision of citizens of both countries are carried out by competent institutions of the state in whose territory they reside, in the manner provided for by the law of that state. Therefore, on the question of a pension at the new place of residence must apply to the competent authorities of the Republic of Moldova.
