the Prosecutor of the Transcarpathian region proved in court illegality of the bodies of state control in the sphere of protection of land resources and local self-government in the introduction of official records in the state statistical reporting false information about the category of land with a view to their further development, which in fact is a land of recreation. We are talking about the stadium «vanguard» in the city of Uzhgorod, which was built back in the early 50-ies of the last century and capital built in 2005. Today, the stadium hosts all sporting events, local and regional level. So, 01 Jun 2016 Transcarpathian district administrative court satisfied the claim of Prosecutor of the Transcarpathian region on the recognition of wrongful acts and the obligations’commitments the reinstatement of status of the land plot of recreational purpose of the stadium «vanguard» in the amount 12,459 ha (within the borders of the fence) that will prohibit in the future to perform any act for the disposal of land specified sporting about’object. Applicable law, including the Land code of Ukraine clearly defines the powers of the Central Executive authority that implements the state policy in the sphere of land relations regarding the planning of territories, the protection and preservation of land resources. However, given the above rules, the bodies entrusted with these obligations’bundles, poulis from performance of such liabilities’commitments that led to the alienation of part of lands of recreational purpose and loss of integrity of significant areas within the field of sports institutions – the stadium «vanguard”. Therefore, when making a lawful decision the court considered the position of Prosecutor's office concerning violations of law and the existence of a real problem of public values, and balanced the need to ensure the needs of society in the development of physical culture and sport, health and active relaxation for residents of the city of Uzhgorod and the Transcarpathian region.
