In the Volyn oblast Prosecutor's office revealed violations of the police law in the application of coercive measures related to restriction of personal liberty of citizens
the Prosecutor's office conducted to verify compliance with the requirements of the current criminal-Executive legislation and legislation on administrative offences in the execution of judicial decisions in criminal proceedings and application of compulsory measures, floor’connected with restriction of personal liberty of citizens in a police region. It is established that during the current year police region administratively detained and taken to the premises of departments and police stations 465. Elicited 5 facts of unjustified handing over of violators to the departments and police departments when possible to draw up protocols on administrative offenses at the place of their Commission. It was also established 34 cases of non-discharge of the materials of the administrative detention of the offender. Not always the employees in the police region reported to the relatives of persons detained for committing administrative offences, the place of their stay. In violation of the law they are also in statutory cases, not misleading Volyn regional center for providing free secondary legal aid about detention of citizens, violating their right to free legal aid. Established and facts of failure by the police authorities region court decisions on imposition of administrative arrest, which contributes to the avoidance of offenders administrative liability. Violated also in the implementation of control concerning the persons condemned to punishments, not floor’connected with imprisonment. Individual preventive work with such prisoners is carried out formally, which led to the fact that during January-may 2016 they committed 14 of re-offending. By results of check the Prosecutor of the Volyn region included the indication of interim’ligament of head of state of NP in the field with the requirement immediately to take measures to eliminate detected violations and to bring to a disciplinary responsibility of officials for their approval.
