Chernivtsi: the Re-registration of non-profit organizations: step-by-step instructions
a non-profit organization before year-end are required to bring their founding documents into conformity with the provisions of the Tax code and submit documents for inclusion in the Register of non-profit organizations. Chernivtsi LIGHTS draws the attention that 16.07.2016 G. entered into force the decree of Cabinet of Ministers No. 440 of 13.07.2016 g. "On approval of Procedure for maintaining Register of non-profit institutions and organizations, inclusion of non-profit enterprises, institutions and organizations in the Registry and de-Registry". Please note that non-profit organizations, which until 01.01.2017 not bring their constituent documents in compliance with the requirements of clause 133.4 article 133 of the Tax code, and provide copies of such document to the Supervisory authority, after 01.01.2017 are excluded by the Supervisory authority of the Registry. The first step. To align with the requirements of the Tax code of the constituent documents The constituent documents should * contain a prohibition of the distribution of the received incomes (profit) or parts of them among the founders (participants), members of such an organization, employees (except for their remuneration, accrual of the single social contribution), members of management bodies and other related persons; * provide for the transfer of assets to one or more non-profit organizations of a certain type or credited to the income budget in the case of the legal entity termination as a result of its liquidation, merger, division, accession, or transformation); * provide that the income (profit) non-profit organization used exclusively to Finance expenditure on the maintenance of a non-profit organization, the implementation of the purpose (goals, objectives) and activities specified in its constituent documents. Second step. For inclusion in the Register, the organization must submit to the authority of DFS (tax) application form 1-PH signature of the head of the organization (authorized person) and company seal (if available). In addition to the statements would be required to submit copies of the constituent documents.
