Volyn: prosecutors insist on the return to the state of 2.5 ha of water Fund lands on Kwartin
Manevichy the local Prosecutor's office appealed to the Kivertsi regional court of Volyn region in the interests of the state with a claim to Kivertsivsky district administration and residents of the city of Lutsk, to nullify the lease contract of the land plot of water Fund area of more than 2.5 hectares and to return the site to the state. Studying the state of the law in the use of lands of water Fund on the territory of Kivertsy district, prosecutors have found that in November 2011 Kvartsa between RGA and the citizen was signed the lease contract of the specified area which is outside the settlements Susica village Council. However, by entering into this agreement, the district state administration contrary to the requirements of laws of Ukraine "On the estimation of land" and "On lease of land" is not adhered to the statutory procedure for determining rent for land, hence rents were calculated and assigned without conducting mandatory’mandatory normative monetary evaluation of land. Now, prosecutors are in court to seek termination of the lease and return the land to the state.
