Reversing the decision of the investigator,the Prosecutor's office resumed the investigation on the fact of seizure of land for construction on the Hill of Fame in Rivne
police Investigators in 2014-2015 conducted pre-trial investigation of criminal offenses under part 3 St. 197-1 (unauthorized occupation of land and unauthorized construction), article 246 (illegal cutting of forests) and part 2 of article 364-1 (abuse of authority by an official legal entity of private law irrespective of organizationally-legal forms) of the criminal code of Ukraine. The results of this investigation criminal proceedings were closed because of absence in act of structure of a criminal offense. However, given the significant public interest that concerns the public in connection with the continuation of construction works on the Hill of Fame in Rivne, at the direction of the Deputy Prosecutor of the Rivne region was claimed materials of criminal proceedings with the Main Directorate of NP in the Rivne region. After the carried-out inspection it is established that the decision on closing of criminal proceedings taken prematurely in connection with the incompleteness of the pretrial investigation. In this regard, the Deputy Prosecutor of the Rivne region has cancelled the decision about closing of the criminal proceedings and instructed the investigating police officers to ensure the full and impartial investigation of all circumstances of Commission of criminal offenses, and prosecutors-heads of pre – trial investigation, and effective oversight in the form of procedural guidance.
