The Chernivtsi mayor Alex Kaspruk believes that the city Council was wrongfully denied the office of physical culture and sport in the provision of land for construction of the sports complex
mayor Alex Kaspruk stopped action of decisions of the city Council, which the deputies refused the office for physical culture and sport to approve the allocation plan and to submit to permanent use of land plot on the street. Rivne area 6,3113 hectares for the construction of a sports complex. Permission for the construction of a sports complex and a draft allocation of land for permanent use estimated area of 7.0 ha. on vul. Rivne Department for physical culture and sport was received in September 2008 ( decision of the Chernivtsi city Council from 11.09.2008 ¹685 as amended by decision dated 25.02.2010, No. 1248). To implement these decisions of the city Council in accordance with part 4 of article 123 of the Land code of Ukraine Department on physical culture and sports of the city Council has developed the project of land management on branch of the land plot in permanent use. Under part 6 and part 13 of article 123 of the Land code of Ukraine Department on physical culture and sports of the city Council appealed to the city Council about the approval made the project of land allocation and the granting of this land for permanent use for construction of a sports complex. According to the Land code, the basis of refusal of approval of a land management project concerning allocation of land can only be its non-compliance with laws and adopted according to them normative legal acts. In violation of the above-mentioned norms of the Land code of Ukraine, and also contrary to the previously adopted resolution of the city Council, Chernivtsi city Council decision from 31.10.2016, No. 453 land on St. Rivne, 7, area 6,3113 ha secured the Chernivtsi city Council that is not consistent with the requirements of article 74 of the law of Ukraine "About local government in Ukraine" concerning the responsibility of local authorities before the territorial community, the state, legal and natural persons and article 19 of the Constitution of Ukraine that the bodies of state power and bodies of local self-government, their officials are obliged to act only on the basis, within powers and in the way provided by the Constitution and laws of Ukraine.
