Chernivtsi: the terms of appointment and calculation of pensions according to the law of Ukraine “public service”
the Law of Ukraine "On public service" No. 889 as of December 10, 2015, which entered into force on 01 may, 2016, defined the terms of appointment of civil service pensions. With the adoption of this Law, the Law of Ukraine “public service” No. 3723 of December 16, 1993 repealed, except for article 37, which applies to the persons referred to in paragraphs 10 and 12 of section Final and transitional provisions of the Law of Ukraine "On state service" of 2015. Thus, in accordance with paragraph 10 of the Concluding and transitional provisions of this Law, public servants who as of may 1, 2016 hold positions of public service and with not less than 10 years of experience in positions related to the corresponding categories of positions of state servants are entitled to pensions in accordance with article 37 of the law of Ukraine "On civil service" of 1993. Paragraph 12 of the Concluding and transitional provisions the new Law provides that for persons who as at 01.05.2016 have at least 20 years of experience in positions related to the corresponding categories of positions of state service, shall retain the right to pension according to article 37 of the law of Ukraine “public service” from 1993. In turn, the position assigned to the corresponding categories of positions of state servants and public service, article 25 of the law of Ukraine “public service” from 1993, and acts of the Cabinet of Ministers of Ukraine. Thus, persons assigned to the relevant categories of civil servants are assigned the rank of the civil servant within a particular category. Conditions of appointment of pensions to civil servants specified the Procedure of granting pensions to certain categories of persons, approved by the decree of the Cabinet of Ministers of Ukraine of 14 September 2016 No. 622. Taking into account the standards of this Ordinance, the right to pension of the civil servant in the framework of the Law of Ukraine “public service” from 2015 are that: 1) did not receive a pension according to the law of Ukraine “public service” from 1993; 2) reached retirement age: – women – under article 26 of the Law of Ukraine “On compulsory state pension insurance”; – for men of a certain article 37 of the law of Ukraine “public service” from 1993; 3) have the necessary special experience for the positions specified in the paragraph 10 and 12 of the Final and transitional provisions of the new Law; 4) have the necessary insurance period for women and 30 years for men 35 years of age. It should be noted that the pension of a public servant may amount to 60 per cent of their wages, which includes all types of remuneration, which paid a single fee for obligatory state social insurance. Persons who at the time of treatment in the appointment of pensions are not government employees to a pension amounting to 60 per cent of the wage working state employee relevant post and grade at the last place of public service that includes all types of remuneration, which was paid a single fee for obligatory state social insurance. In calculating pensions to the state employees salary, allowance for rank and seniority are taken into account in the amounts established at the date of application for assignment of pension for the last occupied position of the civil service. Other benefits are accounted for the calendar months of working as a civil servant starting from 1 may 2016. Persons who have at least 20 years of work experience in positions related to the categories of positions of state servants, and which at the time of retirement are not in the public service, at their request, the size of payments (except official salary, supplements for rank and years of service) may be determined in average size relative to certain legislation of such payments for the month preceding the month of application for a pension, but not earlier than may 2016, at the corresponding positions (positions) for the last place of work in the public service.
