In Zhytomyr region more vulnerable social groups will have access to free legal aid
Poroshenko has signed the Law of Ukraine "On High Council of justice", which amends the Law of Ukraine "On free legal assistance" in terms of expanding the circle of persons entitled to free secondary legal aid. These changes will come into force on 5 January 2017. The purpose of these changes is the strengthening of social guarantees by expanding the circle of persons entitled to state-guaranteed free legal assistance. First of all, we are talking about internally displaced persons and persons who had only a claim to such a status. Thus to take advantage of the qualified legal aid can now about 1 700 000 people – this is the approximate number of registered internally displaced persons. The same social guarantee is provided for individuals applying to receive the status of combatants. Moreover, free secondary legal assistance to veterans of the war, including combatants (about 275,000 people), other persons subject to the law of Ukraine "On status of war veterans, guarantees of their social protection", will be given not only regarding their social protection, as it was before the adoption of the said amendments, and any other issues. Also significantly changed the approaches to defining low income, what is the criterion for obtaining the free secondary legal assistance is not less than 10 000 000 people: * first, the person would have such a right if her income does not exceed two minimum subsistence levels; * second, will be considered the average monthly income of the person who seeks help, not the average total income of the family, as it was until now. The changes take into account the objective need for ensuring access to free legal aid to persons who have income equal to the subsistence minimum, or even more, however, is insufficient for self-payment of legal services. In addition, the amendments make a person independent from the income of other family members in the matter of applying for free legal aid. First of all, it will give the possibility of seeking such assistance from individuals, the legitimate rights and interests are violated in the family.
