Volhynia: the Prosecutor's inspection revealed violations in the work of police region
the Prosecutor's office of Volyn region has spent check of observance of requirements of the current legislation on administrative offences in the execution and application of enforcement measures, floor’connected with restriction of personal liberty of citizens in organs of the Main Department of the National police in the area. As of December 1, 2016, on the performance of the police was outstanding, 146 court rulings on the application to the offender of an administrative penalty in the form of arrest, accepted by the courts of the region for 2014-2016. The audit for the intervention of bodies of Prosecutor's office made 28 of these court decisions and another 118 remained in the performance. The reason for the failure to comply with these regulations are an improper exercise of its powers by officials of the police, which brought to administrative arrest citizens not serving. Moreover, due to avoid administrative sanctions on the person again commits an administrative offense. The results of inspections on elimination of the revealed violations of the law by bodies of Prosecutor's office of area brought 19 instructions to the heads of police, 8 of them considered the disciplinary charges brought against 4 officials. When checking the status of the law in administrative detention and the transportation of offenders to the authorities of GU NP region'has revealed that during January-November 2016 police region, administratively detained and taken to the departments and police stations 1015. Revealed 11 facts of groundless delivery of offenders to police departments when possible to draw up protocols on administrative offenses at the place of their Commission. Are 47 cases of non-discharge of materials about administrative detention of offenders. Not always the employees in the police region reported to the relatives of persons detained for committing administrative offences, the place of their stay. In violation of the requirements of the current legislation, police are sometimes not informed the Regional centers of free secondary legal aid in Volyn region on detention of persons. Established cases of unjustified detention for more than three hours. On elimination of the revealed violations of the current legislation, bodies of Prosecutor's office of area brought 24 instructions to the heads of police, upon review of which 17 were disciplined 11 officers and 7 other guidelines are under consideration.
