Chernivtsi: the attention of pensioners on the payment of pensions in 2017
In connection with the entry into force from December 27, 2016 with the Law of Ukraine "On amendments to some legislative acts of Ukraine" ¹1774-VIII of 06.12.2016, temporarily, in the period up to 31 December 2017, to the persons who hold positions of public service, defined by the Law of Ukraine dated 10.12.2015 No. 889-VIII “public service”, as well as working positions and conditions stipulated by the law of Ukraine “About Prosecutor's office”, “On judicial system and status of judges”, the assigned pension/monthly lifetime allowance shall not be paid. During the work on the other posts/works pensions that exceed 150 percent of the subsistence minimum established for persons incapacitated, shall be paid in the amount of 85 percent of the assigned size, but not less than 150 percent of the subsistence minimum established for persons incapacitated. So, the working persons pension payment which exceeds 01.01.2017 1870,50 UAH. during the period the pension is paid in the amount of 85 percent of the scheduled amount, but not less than UAH 1870,50. (01.05.2017 – 1968,00 UAH. with 01.12.2017 – 2059,50 UAH). This restriction against working in other occupations/jobs does not apply to recipients of pensions according to the Law of Ukraine "On pensions of persons discharged from military service and certain other persons." In addition, according to the Law No. 1774-VIII in 2017 the right to pension payment in the amount of 85 percent of the assigned size, but not less than 150 percent of the subsistence minimum established for persons incapacitated, he received persons who work as forensic experts, persons who serve in local government, employees of the National Bank of Ukraine and the working assistants-consultants of people's deputies of Ukraine. Regardless of the fact of employment and position, where working pensioners, a pension (of any kind) is paid in full to invalids I and II groups, invalids of war III groups and combatants, the persons referred to in paragraph 1 of article 10 of the law of Ukraine “On the status of war veterans, guarantees of their social protection”. It also provides that the payment of pensions assigned to persons subject to the law of Ukraine “About the status of veterans of military service, veterans of internal Affairs agencies, veterans of the National police and some other persons and their social protection”, in accordance with the laws of Ukraine "On civil service" and "On pension provision of persons, dismissed from military service and certain other persons" during work in positions of public service, defined by the Law of Ukraine “public service”, and on posts and on the terms stipulated by the law of Ukraine “About Prosecutor's office”, “On judicial system and status of judges” and the payment of the pension to other persons, the pension is assigned according to the law, during the period of service in bodies of local self-government is exercised in full. The foregoing limitations on the payment of pensions, the monthly lifelong cash allowance provided by Law No. 1774-VIII do not apply during the special period to pensions, the monthly lifelong monetary contents, assigned: to persons who undergo military service or are in positions in the Ministry of defense of Ukraine, the Main intelligence Department of the Ministry of defense of Ukraine, Ministry of internal Affairs of Ukraine, the National police of Ukraine, the staff of the national security Council and defense of Ukraine, State special transport service, the security Service of Ukraine, foreign intelligence Service of Ukraine, the State border service of Ukraine, Management of state guard of Ukraine, The state penitentiary service of Ukraine, State service of Ukraine for emergency situations, the State service for special communications and information protection of Ukraine, National guard of Ukraine, bodies of military Prosecutor's office; those who take part in antiterrorist operations, implementation of measures to ensure law and order at the state border, repelling armed attacks on protected objects by military personnel, the release of these objects in case of capture, the reflection of the forcible appropriation of weapons, combat and other equipment. In addition, these restrictions do not apply to pensions awarded in accordance with the laws of Ukraine “About Prosecutor's office”, “On judicial system and status of judges”, during the persons to whom they are assigned, of powers of the members of the High qualifications Commission of judges of Ukraine and High Council of justice. Procedure for payment of pensions awarded under the law of Ukraine “On scientific and scientific-technical activities” in 2017 has not changed. Given these changes, to ensure correct payment of pensions to pay attention to pensioners, that in case of hiring or dismissal (including physical persons-entrepreneurs or business interruption), translation from post to post, a job that gives reason to apply or remove restrictions on the payment of pensions and pensioners shall promptly report these circumstances, the authority of the Pension Fund of Ukraine at the place of stay. Additionally, please note that according to the Law No. 1774-VIII of 06.12.2016, like last year, the maximum pension (including bonuses, raises, additional pensions, the target monetary assistance, pensions for special merits to Ukraine, indexation and other surcharges to the pensions established by the legislation, except for extra allowances to separate categories of persons having special merits before the Homeland) cannot exceed ten subsistence minimum established for persons incapacitated. Temporarily, until 31 December 2017, the maximum size of pension (taking into account the above-mentioned components of the pension payments) may not exceed 10740 hryvnia.
