In the Rivne region, the Prosecutor's office does not constitute protocols on administrative offences related to corruption,but at the same time continuing to implement measures to combat corruption

an Important role in the fight against corruption is played by the enforcement of the legislation on administrative offences. The law of Ukraine "On prevention of corruption" defines the list of specially authorized subjects in the sphere of corruption counteraction, which, in particular, include the Prosecutor's office. At the same time in connection with changes in legislation, starting with 15.08.2016, from the day when the operation started the National Agency for prevention of corruption (hereinafter NAPC), the prosecuting authorities are deprived of powers to draw up protocols on administrative offences related to corruption. The only body on the territory of Rivne region (not yet established territorial division of the NAPC), mandated the development of such protocols, acts in the structure of the National police of Ukraine is the Department for the protection of the economy in Dnipropetrovsk region, Department of protection of economy of the National police of Ukraine. In accordance with the provisions of article 255 of the Cao the bodies of internal Affairs (National police) have the right to draw up protocols on administrative corruption offenses, as provided by the articles 172-4 – 172-9 this code of conduct. However, the prosecuting authorities continue to implement measures aimed at combating such negative phenomenon as corruption. In particular, according to the Law of Ukraine "On prevention of corruption" prosecutors in 2016 146 made representations to the heads of agencies and organizations to address the causes and conditions that contributed to the Commission of offences related to corruption. Along with this, during the second half of last year (after the legislative changes concerning the drafting of Protocol) the Prosecutor's office revealed 4 facts of the act containing signs of administrative violations, materials which are submitted to the Department for the protection of the economy in Dnipropetrovsk region, Department of protection of economy of the National police of Ukraine. Until the termination of powers on drawing up of administrative protocols 20 protocols on Commission of administrative corruption offenses prosecutors sent to court (one-third of all protocols submitted to the court by law enforcement agencies of the region). Exposed violations concerned failure to comply with requirements concerning communication about the conflict of interests, restrictions on combining and overlapping with other activities, get a gift, violation of requirements of financial control. All prosecutors compiled protocols on administrative corruption offenses have already been considered by the court – the perpetrators fined. Preventing and combating corruption remains one of the priorities of law enforcement agencies, particularly the Prosecutor's office. Work in this direction continues.
