To the Department of labor and social protection of population of regional state administration receives written requests and phone calls on the issues of observance of labour legislation concerning workers recruited by military service during the special period. The questions raised are different: there is a service contract the basis for the release of the employee from duty? Whether the company is obliged to keep the place of work, position and average earnings? As kompensiruet the enterprise from the budget of the average earnings paid to such employees? Whether the company is obliged to submit to the authority of social protection of population reports on the actual cost of paying compensation from the budget of the average earnings? According to part 3, article 119 of the Labor code (as amended by the Law of Ukraine from 06.12.2016, No. 1769-VIII "On amendments to some legislative acts of Ukraine concerning improvement of an order of passing of military service") for employees, accepted on military service under the contract in a particular period, retained the place of work, position and average earnings for the period until the end of the special period or until the date of actual dismissal. Employee only oulimata from exercising the powers, the reason for this is the copy of the order, an extract from the order of the military Commissariat or extract from the order of the military unit about passage of military service.
