Through the intervention of the Prosecutor's office of Rivne returned from unlawful rent a number of premises of educational institutions
Bodies of Prosecutor's office of Rivne region continue to take measures concerning the return of communal property illegally transferred in rent of premises of educational institutions. With the aim of protecting national and public interests, the prosecution of Rivne region this year, said in court claims with the requirement to stop illegal use of 4 school facilities. In particular, the audit found that part of the premises KZ "idea training center comprehensive sanatorium boarding school of I-III degrees" leased entity and used for a purpose not connected with educational process, that is not on purpose that is a violation of the requirements of article 63 of the Law of Ukraine "On education". In this regard, Rivne local prosecutors filed a lawsuit to the economic court of Rivne region for annulment of the lease, the obligation to return to school premises to the municipal property. Such a reaction of the Prosecutor's office prompted the heads of enterprises and public institutions during the court proceedings to voluntarily terminate the said agreement, so the court made a decision to cease production. Also, the resolution of the Supreme economic court of Ukraine from 08.02.2017 confirmed the legality of decisions of courts of first and appeal instances, which satisfied the claim of the Rivne local Prosecutor's office for annulment of contract of lease of premises of Rivne educational-industrial complex with an area of about 390 sq m cost 416 thousand UAH and obliged private enterprise to release him. All in all, the past and current years for the intervention of prosecutors to terminate the lease of the premises of schools and other educational institutions with a total area of over 800 sq m worth 1.1 million UAH for further use in the interest of the students. Currently, work in this direction continues.
