At a seminar in the Prosecutor's office of Volyn discussed the problematic issues of consideration of complaints on decisions of a Prosecutor.
The Prosecutor's office in the Volyn region with participation of heads, Deputy heads and prosecutors of local Prosecutor's offices held a training seminar on the theme: “the Practice of consideration by the investigators by the judges against decisions, actions or inaction of the investigator and the Prosecutor during pre-trial investigation and procedure for the review and powers of the Prosecutor with the decision of the appeals on these issues”. Opening the seminar, head of the regional Prosecutor's office Vadim Starchuk noted that the current criminal procedural code of Ukraine introduced new institutions – appeal against decisions, actions or inaction of the investigator and the Prosecutor during pre-trial investigation. However, as shown by the judicial practice, certain procedural aspects are not clearly regulated, and in some cases not clearly formulated rules, which govern the actions and decision-making, the actual failure of which leads to the treatment of complaints. Then, the participants identified the problematic issues that arise when considering complaints on certain types of omissions of investigator or public Prosecutor during pre-trial investigation. A lively discussion, the audience raised questions against the decision of the investigator, the Prosecutor on closing of criminal proceedings and the refusal to recognize the victims. He worked for the participants and features of the appellate review of decisions of the investigating judges, accepted by results of consideration of complaints on decisions, actions or inaction of the investigator or public Prosecutor during pre-trial investigation, and the status of judicial practice. Summing up, participants agreed on the opinion that judicial control in the consideration of complaints on omissions of the investigator and Prosecutor is designed to provide appropriate response to the cases initiated by citizens, floor’connected with the implementation of tasks of criminal proceedings how about protection from criminal offences, and to everyone who has committed a criminal offence, has been prosecuted.
