On the claim of Prosecutor's office declared invalid the results of the bidding and the contract for the purchase of Rivne city Council car for the budget
Economic court of Rivne region supported the position of the prosecution Rivne region and satisfied the claim of Executive Committee of Rivne city Council and the private company about recognition void results of the tender procedure, the contract for the purchase of the car "Volkswagen", which costs 400 thousand UAH. The basis for the adoption by the prosecution of measures of Executive nature are the established facts of violations of the budget legislation and the Law of Ukraine "On public procurement". In particular, the customer has not been complied with legislation procurement. In addition, the technical characteristics of the car specified in the tender document differed from the technical specifications of the subject contract for the purchase, which is a violation of requirements of article. 35,36 of the Act. However, despite existing violations, the parties the contract was concluded, which, subsequently amended and unnecessarily increased the cost of the car. With the aim of protecting state interests Rivne local Prosecutor's office filed a lawsuit, which satisfied in full.
