The Prosecutor's office of Vinnytsia region secured the return of property to an educational institution in
to protect the rights of children and the state in the educational sphere Vinnytsia local Prosecutor's office filed a lawsuit to the Economic court of Vinnytsia oblast on annulment of the contract of lease of immovable property belonging to municipal property, concluded between the Department of education of Vinnytsia regional state administration and JSC «maintenance training», and return the premises of the school. In court, the prosecutors essentially defended the position that the above agreement is unlawful, being contrary to the established by law procedure of transfer to rent of property of educational institution. Moreover, the use of PAO «maintenance training» school premises for the placement of communication equipment to provide services wired star’'yazku in close proximity to the children, contrary to the government guaranteed the right to safe and harmless conditions of study and work for students and pupils of the school. Economic court of Vinnitsa region agreed with the arguments of the Prosecutor and denied the above claim. Not agreeing with a court decision, the Prosecutor's office of Vinnytsia region addressed with the appeal complaint in the Rivne economic court of appeal. Consistently defending the legal position regarding the illegality of the above lease agreement, the Prosecutor's office proved in the court of appeal of the illegality of the lease of the school premises with a view to its use PAO «maintenance training» for entrepreneurial activities. By results of consideration of the appeal of the Rivne economic court of appeal overturned the decision of the court of first instance invalidated the above rental agreement and returned to the educational institution the specified room. According to the court decision, the school returned the ability to use the specified premises and use it for the needs of the educational process.
