In Volyn region at the principled position of the Prosecutor of the perpetrator of a fatal accident went to jail for 4 years
the Prosecutor's office of Volyn region, disputing in the courts of several instances of the sentence Rozhischensky district court, according to which 31-year-old man responsible for a deadly accident was sentenced to more m'what than provided by the law, have made for a fair punishment. The evening of 25 February 2016, in a state of alcoholic SP’intoxication behind the wheel salavage tractor brand "DÀF", the man was moving on the highway message Lutsk-Kovel in the direction of Kovel. At a railway crossing in the village of Kozin Rozhischensky district he was speeding and drove into the oncoming lane and made a collision of tractor / car brand "AUDI-80". In result of road accident the driver of a passenger car died. The court of first instance found the truck driver guilty of violating the rules of traffic safety, entailed death of the victim (criminal offense under part 2 of article 286 of the criminal code) and has appointed to it punishment in the form of 1 year and 6 months imprisonment with deprivation of the right of management by vehicles for 3 years. The sanction of part 2 of article 286 of the Criminal code of Ukraine prescribes punishment from 3 to 8 years of imprisonment, and the driver committing a criminal offense that resulted in human death, according to prosecutors, excluded the possibility of assigning penalties more m'what than provided by law. The prosecution appealed against the verdict in the appellate and cassation order. The court of cassation, accepting the appeal of the Prosecutor has appointed new trial criminal proceedings in the court of appeal. The court of appeal of Volyn region, listening to the arguments of prosecutors, appointed the culprit a sentence of 4 years imprisonment with deprivation of the right of management by vehicles for 3 years.
