the Deputies of Chernihiv city Council approved the Order of temporary dismantling (metal) garages in the city, which provides a mechanism, the grounds, terms and procedure of dismantling the garages, which are placed, with the further treatment of the dismantled objects, as well as reimbursement for costs associated with their removal. In Chernihiv the condition of improvement, ensure cleanliness, order, maintenance and cleaning of streets, yard areas, parks and the observance of silence in public places in control of the municipal enterprise "Municipal police" of the city Council. In February of this year by order of the mayor created the Commission on inventory of temporary structures, outdoor areas, garages, utility buildings, outbuildings on the territory of the city, which verifies the legality of their placement. According to the act the Board's inventory in the city is 786 metal garages without obtaining the appropriate permits and 243 objects is established on the basis of permits, however, there is a need for checking the validity of these documents. The garage shall be dismantled and the territory bringing to its previous state in the following cases: - the absence of a decision of the Executive Committee of the Chernihiv city Council, the district in the city of Chernihiv councils or their Executive committees on the granting of permits for the installation of the garage; - discrepancy established garage permits; - detection of abandoned garage; - the absence of documents confirming the right of use (ownership) of the land plot under the installed garage; - the use of a temporary garage owner (the user) for commercial activities; - in other cases stipulated by the current legislation of Ukraine. According to the adopted Procedure in identifying the garage that is installed with such defects, will be drafted the act. The garage will host an informational message (label) with notification within two weeks to report to the authority and to provide permits for the placement of an appropriate garage. In addition, the Order provided: in case of absence sobiratelyam a specified period and submission of licensing documents, the act and the materials of photographic images by the authorized body shall be submitted to the Commission on dismantling, which grants permission to dismantle the garages. The Commission may include members of the city Council, one from the parliamentary factions, the employees of the structural subdivisions of city Council and members of the public. A copy of the decision of the Commission within five working days from the moment of its adoption is passed to the person by registered letter with acknowledgment of receipt, or will be provided a receipt (if known). If impossible to notify a person through email notifications, a notification of the date and time of the demolition of the garage will be posted on the official website of the Chernihiv city Council. The person who has illegally installed garage shall at his own expense to carry out the dismantling of the garage and placed to restore damaged landscaping at the locations. If within 14 calendar days by a person not submitted documents on the right of placement of the garage and has not conducted its dismantling are not taken to release the garage from the vehicle, the authorized body carried out the dismantling of the garage, and found the owner moved the vehicle to a temporary storage site. Payment for demolition of the garage will be at the expense of the city budget. Within three working days from the date of dismantling of the garage, the authorized body shall send the person (if known), in case of her absence in carrying out the dismantling, by registered letter with acknowledgment of receipt or provide a receipt notification of the dismantling of the garage, his place of temporary storage. The same information will be posted on the official website of the Chernihiv city Council. The results of the garage and property that was in him (if available) will be carried out after reimbursement of expenses authorized person authority for performance of the dismantling and the provision: of identity documents; documents or other evidence proving the right of ownership of the dismantled garage or the right of lawful possession, use, documents or other evidence proving the right of ownership (use) and other rights on material goods, personal belongings that were in the garage; the documents confirming reimbursement of costs associated with the dismantling of the garage. The return of a temporarily detained vehicle stored on site temporary storage is carried out at the written request of the owner (legal user), provided compensation for their costs associated with transporting and storing such a vehicle.
