Chernivtsi: the Recalculation of pensions for length of service
in Accordance with part 4 of article 42 of the law of Ukraine “On compulsory state pension insurance,” (more – the law), the pension recalculation taking into account insurance record acquired after appointment (the previous recalculation) of pension is: – in the presence of the insured person not less than 24 months of an insurance experience after appointment (the previous recalculation) of pension regardless of interruptions; – in case the insured person after appointment (the previous recalculation) of the pension insurance period is shorter – not earlier than two years after appointment (the previous recalculation) of the pension. Recalculation of pensions is made within the period specified by article 45 of the Law, namely: on the first day of the month in which the pensioner applied for pension recalculation, if the corresponding statement with all necessary documents submitted to the 15th inclusive, and from the first day of the following month if the application with all necessary documents filed after the 15th day. According to item 1.5 of the Procedure for the submission and processing of documents for appointment (recalculation) of pensions according to the law of Ukraine “On compulsory state pension insurance,”, approved by resolution of the Board of the Pension Fund of Ukraine ¹22-1 of 25.11.2005, registered in the Ministry of justice of Ukraine of 27.12.2005 ¹1566/11846 (hereinafter – the Order), the statement for pension recalculation is submitted by the retired person or his legal representative to the appointing authority retire, stay on the account as beneficiary of pension, on the form specified in Annex 2 of the Order. The person who applies for a pension (regardless of retirement), must present a passport (or other document certifying the person, the place of his residence (registration) and age – clause 2.9 of the Order). Thus, for the recalculation of pensions in accordance with part 4 of article 42 of the Act, a person has the right to apply to the management of the Pension Fund at the place of stay on the account and provide a statement. It is necessary to have the passport of the citizen of Ukraine and the document on assignment of registration number of accounting card of the taxpayer (or certificate on compulsory state pension insurance). At the same time, the project of pension reform assumes that such operations in the future will be carried out by the Fund without the need for additional handling persons.
