Chernivtsi city Rada has obliged officials on the complaints of citizens and legal entities on land issues to consider for 5 days
Chernivtsi city Council did not listen to the comments of the mayor Alexei Kaspruk and 29 votes confirmed its decision which determined that the draft decisions regarding land issues on the appeals of citizens, legal persons and organizations are compiled and published on the official web-portal of the Executive bodies of the city Council within five working days from the date of receipt of statements. Legal Department city Council noticed that the officials are not physically able to comply with the MPs of the term, as you won't be able to make a documentary and legal analysis of the appeal, to investigate the situation. In addition, it is contrary to the Law of Ukraine "About addresses of citizens", which specifies that appeals are considered and settled within a period of not more than one month from the date of their receipt, and those that do not require further study, – without delay, but not later than fifteen days from the date of receipt. If within a month to solve broken in appeal the question is not possible,the law provides that the supervisor of relevant body, enterprise, institution, organization or his Deputy establish necessary term for its consideration, as reported by the person who filed the appeal. The total term solution to the issues raised in the appeal, can not exceed forty-five days. Mayor Alex Kaspruk also said that reducing the statutory deadline to 5 working days from the date of receipt of the appeal will lead to disruption in the work of the Executive bodies of the Council, the deterioration in the quality of preparation of projects of decisions of city Council adoption of the unfounded, illegal decisions and violations of the rights of citizens. The result can be an increase in claims and complaints of citizens, the growth of lawsuits about recognition illegal decisions of the city Council and their cancellation. Members of the comments of the mayor Alexei Kaspruk and the legal Department of the city Council did not listen and 29 votes confirmed its previous decision.
