As previously reported, the Vinnytsia district administrative court satisfied the claim of the Deputy head of the Vinnytsia local Prosecutor's office in interests of the state represented by the Ministry of education and science of Ukraine, Department of education and science of Vinnytsia regional state administration, state educational institutions called the winery about cancellation of illegal decisions of one of village councils of the Vinnytsia region, in which the state was out of a land plot with a total area of almost 22 ha, which was in constant use vocational schools of social rehabilitation. Not agreeing with a court decision, the defendant – Akushinski village Council has addressed with the appeal complaint in Vinnitsa administrative court of appeal. Consistently defending the legal position, the prosecution Vinnytsia region proved in the court of appeal of the illegality of the decisions of the village Council. Definition of Vinnitsa administrative court of appeal 12.07.2017 upheld the decision of the Moscow district court, which recognized illegal and cancelled the decision of the sessions Akushinskogo village Council according to which illegally terminated the right to use the land of the institution and the development of technical documentation on land management regarding its division. Therefore, based on this court decision, the educational institution is returned to the right to use the land plot with a total area of nearly 22 hectares, worth 24 million, which he will be able to register in the manner prescribed by law and continue to use it for the needs of the educational process.
