On the claim of Prosecutor's office declared invalid the procedure of bidding and procurement of works on 64,2 million UAH,intended for cleaning of roads in Rivne
Economic court of Rivne region Rivne supported by the position of the local Prosecutor's office and invalidated the results of the bidding and the contract for the procurement of works and services total cost of 64.2 million UAH with the supplemental agreement signed between the Rivne city Council and Municipal Rivne road-maintenance administration of motor roads. A specified amount of funds was planned to allocate from the local budget for cleaning, treatment and maintenance in proper condition of streets, passages and squares of m. Exactly. The basis for the adoption of measures by the Prosecutor's office representative character have become established facts of gross violations of requirements of the Law of Ukraine "On public procurement". In particular, the organizers of the bidding procedure were not observed the principle of openness and transparency at all stages of procurement, as well as the legally established procedure. In addition, the winning bidder was declared the participant whose proposal did not meet all the conditions and eligibility criteria specified in the tender documents. However, despite existing violations, the parties entered into in February 2017, the contract on performance of works and services for a total amount of 64.2 million, further reducing (in accordance with the additional agreement) amount of the contract, to 36.3 million. With the aim of protecting state interests Rivne local prosecutors filed a lawsuit to invalidate the results of the bidding and contracts for the purchase of services, which satisfied in full.
