Uzhgorod local Prosecutor's office initiated criminal proceedings in the sphere of land relations
Uzhgorod local Prosecutor's office began criminal proceedings concerning officials of one of village councils in Uzhgorod district on the fact of abuse of power or official position (part 2 of article 364 of the criminal code of Ukraine). According to the Deputy head of Uzhgorod local Prosecutor's office Mikhail Panto, those officials, in violation of the requirements of the Land code of Ukraine, without changing the designation of a land plot for agricultural purposes, in the absence of the developed project of land plot for use without withdrawal of land from the previous use and approved the project of land allotment for commercial purposes and provided it in the lease, other sub’object of management. During the use of this land area of almost 2 hectares, and the inaction of the officials of the village Council, sub’object of management has been illegally built up its commercial about’objects. As a result of illegal actions of officials of the rural Council and the sub’agriculture, infringed the legal regime of use of agricultural land that caused damage to the state interests in the amount of almost 4 million UAH, so it is normative monetary valuation of land of the lost. Reference: part 2 of article 364 UK Ukraine - abuse of power or official position, that is intentional, for mercenary motives or in other personal interests or in interests of third parties, the use of official authority or official position contrary to interests of service if it entailed grave consequences, caused substantial harm to legally protected rights, freedoms and interests of individual citizens or state or public interests, or interests of legal entities, - shall be punishable by deprivation of liberty for a period from the u'five to eight years with deprivation of the right to occupy certain positions or engage in certain activities for a term up to three years.
