Thanks to the principled position of the Prosecutor of the Transcarpathian region, Lviv economic court of appeal upheld the decision of Zakarpattya region Economic court dated 19 October 2015, which was satisfied the claim of Prosecutor's office of Uzhgorod in the interests of the state in the face of Department of municipal economy of Uzhgorod city Council to a limited liability company that was going to carry out works on reconstruction of street lighting systems in m. Uzhgorod, in the part of collecting funds in the city budget for the sum almost 700 thousand UAH. As reported in local Uzhgorod Prosecutor's office, appropriate funds to the Department of municipal economy of Uzhgorod city Council were transferred to the company as advance payment under the contract on the implementation of the relevant work. However, the contractor funds advance in a particular contract term is not used, the reconstruction of street lighting systems in m. Uzhgorod not started, what was the basis for the appeal of the Prosecutor's office of Uzhgorod in the court to the lawsuit. At present, the decision of the court of first instance on collecting from the company cash in the amount of almost UAH 700 thousand. came into force and the said amount shall be returned to the local budget.
