The Prosecutor's office in the Volyn region is taking steps to return to the state land worth more than 1 million 100 thousand UAH.
Head Manevichy the local Prosecutor's office of Volyn region has addressed in court with a claim to Kostushko village Council and residents of the region to make it impossible for the state registration of land lease agreement and the obligations’to oblige the tenant to return the community land area of almost 10 ha of land, normative monetary evaluation of which is more than 1,1 million UAH. In the study of land lease agreements entered into by the local authorities of the district, the prosecutors established that in April this year, the village Council and individuals was concluded a lease agreement of the land plot of water Fund for maintenance of the pond. Despite the requirements of applicable law, the contract was concluded without an auction, was not agreed with the Volyn regional Department of water resources and its state registration is still not implemented. In addition, the deal was done with the improper tenant, because the best land for fish farming in the use of persons who are not the sub’objects of management – illegal. Because the contract lacks legislation the conditions necessary for its conclusion, the contract is not concluded – prosecutors consider. Due to the lack of a relevant body, whose terms of reference cover the appropriate authority to control the manner of using land of water Fund without sufficient legal grounds, the Prosecutor's office will defend the state's interests in court and will insist that the land to be returned to the territorial community of the village Council.
