31 October, the economic court of Transcarpathian region decided to satisfy the claim of the Prosecutor about recognition invalid and cancellation of decisions of the session of Uzhgorod city Council on the basis of which the National Bank of Ukraine the right of permanent land use of the stadium «vanguard» with an area of 0.44 hectares. As reported by the head of Department of Prosecutor of the Transcarpathian region Andrey Marinich, the Supreme economic court of Ukraine in August 2016, supported the arguments of the prosecution are set out in the appeal and quashed the judicial decisions of local and appellate economic courts, which unreasonably refused satisfaction of such claim. In this case, the court of appeal drew attention to the incompleteness of the investigated courts of the previous instances the circumstances of the case, which must be corrected in the new court. As previously reported, the situation of the waste lands of the stadium was made possible due to the fact that certain competent authorities have withdrawn from the proper discharge of its powers, which led to the alienation of part of lands of recreational purpose and loss of integrity of the territory, meaningful within the field of sports institutions – the Stadium «vanguard» with total area of 12 hectares. At SV’'yazku with the fact that according to the technical documentation for the illegality of actions of relevant bodies, of the earth of the stadium did not have the status of recreation, the city Council was able to discharge part of the land about’object of physical culture and sport, despite the moratorium on changing the destination of individual land plots for recreational purposes in towns and other settlements. It should be noted that the wrongfulness of state control in the sphere of protection of land resources and local self-government to include in the official accounting of the state statistical reporting false information about the category of these lands, it is also proved by the prosecution on another case.
