In Vinnytsia region Prosecutor's office ensured the return of 600 thousand UAH to the state enterprise
At the beginning of 2014 PJSC “the Fund" (which was established by the Cabinet of Ministers of Ukraine in 2013 to support domestic agricultural producers) to one of the farms Pogrebischenske district signed a contract for the supply of grain. Under the agreement the society has listed the farm the advance payment in the amount of 1.2 million UAH, and the economy Zobov’azuelos to 01.10.2014 to convey a grain of wheat in the amount of 1,000 tons. However, the economy these obligations’commitments in specified time is not executed and the funds to the state enterprise have not been returned. The Prosecutor's office of Vinnytsia region in 2015, has addressed in court with the claim about collecting from the farms of the advance payment and penalties in the total amount of 2 million hryvnia. The decision of the economic court of Vinnitsa region 03.06.2015, entered into force 17.11.2016 specified claim is satisfied in full. For the purpose of compulsory execution of the court decision at the request of the Prosecutor's office of area Pogrebischenske district bailiffs ' service opened enforcement proceedings. However, officials of the debtor continuing to conduct business activities and having the opportunity to repay, tried to evade enforcement of the judgment. In particular, repeatedly opened new Bank accounts, as all previously open account arrested by the state Executive. Upon preventing officials of agriculture enforcement of the court judgment by the Prosecutor's office of Vinnytsia region in may 2016 submitted to the Unified register of pre-judicial investigations on signs of the criminal offense under part 3 of article 382 of the criminal code of Ukraine, which is being investigated. In addition, the management of the company appealed to the court the actions of state Executive service for the arrest and seizure of property. The Prosecutor's office of Vinnytsia region took part in the consideration of the specified complaint and proved in court the legality of acts of bodies of state Executive service. According to the results of the measures taken in December 2016, through the implementation of the arrested property, with the economy the debtor collected funds in the amount of 600 thousand hryvnia.
