Chernivtsi: New in assigning pensions to the persons who participated in the ATO
Final provisions of the Law of Ukraine “On compulsory state pension insurance” provides for the appointment of early old-age pensions to servicemen, persons of commanding and ordinary structure of organs of internal Affairs who took part in the fighting and those who have become disabled due to injury, concussion, injury received in the defense of the homeland or in the performance of other duties of military service (official duties), or due to disease connected with stay at the front or the execution of international duty. The right to early retirement age were extended to wives (husbands) if they did not accept remarriage, and parents of servicemen, persons of commanding and ordinary structure of internal Affairs bodies who died (were killed) during the period of military service (official duties) or after dismissal from service but due to injury, concussion, injury received in the performance of duties of military service (official duties), the disease connected with stay at the front, the liquidation of consequences of the Chernobyl catastrophe or the performance of international duty. February 6, 2017 will come into force the Law of Ukraine ¹ 1683-VIII of 18.10.2016 “On amendments to some laws of Ukraine concerning pension provision of certain categories of persons from among participants of the antiterrorist operation”, according to which expands the list of persons entitled to the appointment of early retirement pension in accordance with the Final provisions of the Law of Ukraine “On compulsory state pension insurance”. In particular, the right to appoint early retirement pension after the entry into force of the mentioned Law to have: – military personnel, persons of commanding and ordinary structure of organs of internal Affairs, who participated in the antiterrorist operation in the areas of its implementation, as well as those who have become disabled due to diseases associated with direct participation in the antiterrorist operation in the areas of its implementation; – wives (husbands) if they did not accept remarriage, and parents of servicemen, persons of commanding and ordinary structure of internal Affairs bodies who died (were killed) during the period of military service (official duties) or after dismissal from service but due to diseases associated with direct participation in the antiterrorist operation in the areas of its implementation; – those who are part of the volunteer units took part in anti-terrorist operations, ensuring its implementation, being directly in the areas of the antiterrorist operation in the period of its implementation, provided that in the future these volunteer formations were included in the Armed Forces of Ukraine, Ministry of internal Affairs of Ukraine, the National guard of Ukraine and other educated in accordance with the laws of Ukraine of military formations and law enforcement bodies; – persons who have become disabled due to injury, contusion or mutilation received during direct participation in anti-terrorist operations, ensuring its implementation, being directly in areas of the ATO, provided that in the future these volunteer formations were included in or operated in cooperation with the Armed Forces of Ukraine, Ministry of internal Affairs of Ukraine, the National police, the National guard of Ukraine and other educated in accordance with the laws of Ukraine of military formations and law enforcement agencies. Members of the families of such individuals in the case if a member of the ATO killed (missing), died as a result of injury, contusion or mutilation received at the time of direct participation in antiterrorist operation. – from among reservists, conscripts who defended the independence, sovereignty and territorial integrity of Ukraine and have become disabled due to injury, contusion or mutilation received at the time of direct participation in antiterrorist operation. Their families, if such persons died (went missing), died as a result of injury, contusion or mutilation received at the time of direct participation in antiterrorist operation. Please note that the early old-age pension of the above-mentioned categories of persons shall be appointed after reaching the men 55 years, women – 50 years and if you have been insured for at least 25 years for men and at least 20 years for women. The law of Ukraine “On amendments to some laws of Ukraine concerning pension provision of certain categories of persons from among participants of the antiterrorist operation” enlarged the circle of persons who have the right to pension in case of loss of the breadwinner by the law of Ukraine “On pensions of persons discharged from military service and certain other persons” with a reduction in the retirement age. To assign a pension no earlier than 5 years before reaching the retirement age established by article 26 of the Law of Ukraine “On compulsory state pension insurance” will be able, starting from 6 February 2017, both women and men (if they have not remarried) and parents of servicemen, persons having the right to pension according to this Law, who were killed, died or missing during service or died after dismissal from service but due to injury, concussion, injury received in the performance of duties of military service (official duties), disease connected with stay at the front, the liquidation of consequences of the Chernobyl catastrophe or the performance of international duty, participating in the antiterrorist operation in the areas of its implementation.
