Bodies of Prosecutor's office of Rivne region are taking systemic measures of representative character to protect the interests of the state in court in the sphere of state and municipal property. In particular, last year, prosecutors filed a lawsuit in this area amounting to more than 7.6 million UAH, according to the results of judicial review has already satisfied claims in the amount of more than 5.4 million UAH. By results of processing of the materials revealed 6 facts of criminal offences, what information has been entered in the Unified register of pretrial investigations and initiated criminal proceedings. So the Prosecutor's office of Rivne region have taken effective measures on the real return to public property unlawfully disposed of buildings and structures Dubno bakery. Agreeing with the claims of the Prosecutor's office, Rivne economic court of appeal in December of 2016, decided to annul the decision of the local authority and to cancel the certificate of the right of private ownership of the properties, which cost 4.6 million UAH. It is proved that the solution according to which the joint-stock company was the right of private ownership of property area of nearly 20 thousand square meters, adopted in 2012 illegally – contrary to the established laws, prohibition on the change of ownership form to the above public property. On the execution of judgments registration of the right of private ownership of the said building the plant in February 2017 cancelled by the state Registrar, that means the real return of the state property complex. From the beginning of 2017 to protect the state's interests in the sphere of state and municipal property prosecutors filed a lawsuit in the amount of about 273 million, that are under consideration. So the Prosecutor announced to the court the claim in interests of the state to Kuznecovsk city Council to invalidate its decision, which abolished the order of the Chairman of the city Council, according to which the communal property of the territorial community of the city transmitted the housing facilities area of over 600 thousand sq m.
