In the Rivne region in the court directed the petition for release of officials of legal entities of private law from criminal liability for corruption offences
the Prosecutor's office of Rivne region sent to the court two applications for exemption from criminal liability of two persons who have committed a criminal corruption offense under part 3 St. 369 criminal code of Ukraine (giving undue advantage to the service person). During a pretrial investigation, which was conducted by investigators SU GUNP in the Rivne region, found evidence giving representatives of legal entities of private law of illegal benefit in the amount of 4 thousand UAH each for the officials of the controlling authority, which held a position of responsibility in imposing the minimum penalties in the interests of such enterprises. However, given that the payer has voluntarily contacted law enforcement before registration of criminal proceedings and notification of suspicion of committing criminal corruption offences, such persons shall be released by the court from criminal liability under part 5 of article 354 of the criminal code of Ukraine. Reference: under part 5 of article 354 of the criminal code of Ukraine, the person who offered, promised, or provided illegal benefit, shall be exempt from criminal responsibility for crimes provided by articles 354, 368-3, 368-4, 369, 369-2 of the present Code, if, after the offer, promise or granting illegal benefit she is to receive from other sources of information about offense by Agency or official who by law is entitled to report the suspicion, voluntarily stated what happened on such and actively promoted the disclosure of a crime committed by a person which received undue benefit or accepted the offer or promise. The mentioned exemption is not applied if the offer, promise or giving undue advantage was made in relation to the individuals identified in the fourth part of article 18 of this Code.
