Clarification of anti-corruption legislation: notification of significant changes in the financial status of the entity Declaration
Starting 01.09.2016 in Ukraine there is a system of representation and the publication of the Declaration of the persons authorized to perform state functions or local self-government (E-Declaration). Information about income and property the income of these persons is entered in the Unified state register of declarations and published on the official website of the National Agency for prevention of corruption (hereinafter NAPC). For the solution of NACP, the system began its work in two stages: 01.09.2016 on 31.10.2016 Declaration filled out and filed by individuals who, according to the note to article 50 of the law of Ukraine "On prevention of corruption", held important and very responsible position, and from 01.01.2017 to file e-Declaration are required for all other subjects of declaring. A separate novel for the subjects of Declaration should note the requirements of part 2 of article 52 of the Law of Ukraine "On prevention of corruption", according to which 01.09.2016 in the event of significant changes in the property status of the subject of the Declaration, namely, receipt of income, purchase property for an amount that exceeds 50 times the subsistence minimum established for able-bodied persons on 1 January of the respective year specified entity within ten days of receipt of the income or property acquisition shall in writing notify the NAPC. Thus, after 10 days of receipt of the income or property acquisition in excess of 80 thousand UAH. (because the living wage as of 01.01.2017 is 1600 UAH) the declarant shall make in the Unified state register of declarations of persons authorized to perform state functions or local self-government, relevant information. NAPC also focuses on the fact that revenues include: - salary (cash security) obtained as the main place of work and part-time. Wage refers to basic wage and incentive compensation payments which are paid (provided) in connection with the employment relationship; - fees and other payments in accordance with civil-legal transactions. - income from business or independent professional activity; - income from the transfer of property in rent; - dividends; - interest; - royalties; - insurance payments; - charitable assistance; - retirement; - the inheritance; - the income from alienation of securities and corporate rights; gifts and other income. Reference: Article 45 of the Law of Ukraine "On prevention of corruption" establishes the obligation of submission annually until 1 April by filling out the official web site of the NAPC of declarations of persons authorized to perform state functions or local government. Form notice of material changes in the property status of the subject of the Declaration and rules of filling out this form, approved by the decision of the National Agency from 10.06.2016 registered in Ministry of justice of Ukraine 15.07.2016 No. 961/29091. The information is subject to Declaration personally by completing the appropriate electronic form on the website of the NAPC through their own personal electronic Cabinet of the subject of the Declaration in the system of the Unified state register of declarations of persons authorized to perform state functions or local government.
