Department of state architectural-building control of the city Council shows some of the best performance in Ukraine
About results of work of Department of state architectural-building control of Lutsk city Council Executive Committee members reported to the head of the state architectural and construction control Yuri butterfish. He noted that according to the Law of Ukraine "On regulation of urban development" from 31 December 2015, the Department of state architectural-building control of Lutsk city Council exercises powers for the implementation of the licensing and registration functions as well as the implementation of state architectural-building control of observance of legislation in the sphere of town-planning activities, project documentation, construction norms, state standards and rules in the city of Lutsk. The division has initiated 178 (one hundred and seventy-eight) inspections, of which 8 (eight) – planned and 170 (one hundred seventy) is unscheduled. The main reasons for unscheduled inspections was the identification of the fact of unauthorized construction of the object and the address of physical or legal persons on violation subject to town planning requirements of town planning legislation. Of the total number of inspections of only thirteen construction sites were not identified violations of legislation in the sphere of urban planning, building norms, state standards and rules. The results of the checks were issued 149 (one hundred and forty-nine) decisions about administrative offences, 28 (twenty-eight) decisions on the imposition of a fine for offences in the sphere of urban development. The total amount of fines is 2 300 000 UAH. As of 01.01.2017 paid 920 000 UAH to the local budget. To the State Executive service for compulsory execution was sent to 13 orders, enforcement proceedings which are still ongoing. The Department GASK claim legal work, including in 2016 was provided to the court two claims about the demolition of unauthorized construction. Also the Department of state architectural-building control acts as a defendant in cases concerning appeals against decisions on bringing to administrative responsibility of individuals and legal entities in cases of offenses in the sphere of urban development activities and in administrative cases concerning appeals against the actions of the Department regarding the cancellation of registration of the Declaration on the beginning of construction works. For the year 2016 was 168 (one hundred sixty eight) posts on the beginning of construction works, 757 (seven hundred and fifty-seven) declarations of the beginning of construction works, a 501 (five hundred one) Declaration on readiness of object for operation, returned for revision – 120 (one hundred twenty) returns. Total was 1643 permits. Currently, the level of returns for revision of returns is 10%. Violations of terms of registration of documents is not fixed. The Department was abolished on the 26th of declarations about the beginning of construction works. The Department issued two permits to start implementation of the construction works and three of the certificate about acceptance in operation of the construction. The staff of the Department provides advice to the Department "Center of administrative services in Lutsk" every Thursday from 14.00 to 17.00 at the address: Lutsk, vul. Lesya Ukrainka, 35. The Rapporteur said that at the moment, Kiev is one of the leaders in terms of construction in relation to the number of the population. The management of Dhabi, in the Volyn region carried out a scheduled inspection of the work of the Department, the results of which revealed no violations. By the end of 2016, the President of Ukraine EXTINGUISH Alexey Kudryavtsev noted the work of the Department of state architectural-building control of Lutsk city Council as an example of successful implementation of decentralization policies in the field of urban development. Department of state architectural-building control of the city Council of Lutsk shows one of the best performance since devolution compared to other cities of Ukraine. They managed to establish a dialogue and means of influencing unscrupulous developers and it gives you the opportunity to exercise proper control over observance of legislation in the field of urban development.
