Despite changes in the law under which the rent for the land shall not be less than 3% of normative monetary evaluation of land, more than 71 thousand UAH. spelled out in the contract rents did not change. On repeated requests of the division to Derzeitiger in Manevichi area and Manevichi RGA with the requirement to enter into a supplementary agreement to lease agreement regarding lease payments for land of SPK “Dream” did not react. In the situation interfered with the Prosecutor's office, addressing with the claim in economic court of Volyn region in order to bring the lease into compliance with the requirements of the tax legislation of Ukraine. By results of judicial consideration of a claim of the Prosecutor's office in November 2016 were granted in full. Disagreeing with him, the cooperative appealed to the appeal. However, the court of appeal agreed with the arguments of prosecutors and upheld the decision of economic court of Volyn region. Therefore, the tenant will pay the rent provided for by law.
