From 1 April Vinnytsya region is set to spring-summer spawning ban
for the purpose of preservation of the environment and the conditions of reproduction of aquatic bioresources Vinnytsiamoloko issued an order from 17.03.2017, No. 4-"About establishment of the spring-summer ban on fishing and other aquatic biological resources in fishery water bodies in Vinnytsia region in 2017," which is defined in terms of the ban on fishing and extraction of water bioresources in water reservoirs of the region. Spring-year ban on harvesting of aquatic biological resources during the spawning season in the fishery water objects of Vinnytsia region on the following dates: in the rivers and their tributaries – from April 1 to may 20 (the total duration of 50 days); in reservoirs, lakes, ponds (with the exception of isolated natural or artificial water objects are provided for aquaculture) and Dniester – from 1 April to 9 June (total duration 70 days); in the Dniester reservoir – from April 1 to June 9, for recreational fisheries (total duration 70 days) and from 1 April to 29 June for the commercial fishery (total duration 90 days). Catch crayfish in all fishery waters is prohibited from 1 April to 9 June (total duration 70 days). During spawning, prohibited industrial fishing and Amateur and sports fishing. Prohibits the movement of non-service of boats and the implementation of certain types of economic activity in water bodies and coastal protection strips, such as dredging, drilling, and extraction of gravel. However, as always every rule has exceptions, so in the spawning season of Amateur and sport fishing from shore, one float or bottom fishing rod with one hook and spinning on designated rivers. For gross violation of fishing rules in the spawning season of part 4 of article 85 of the Cao provides for liability in the form of penalty imposing on citizens ranging from 340 UAH. to 680 UAH. with the confiscation of instruments and means of offense, which are the private property of the infringer, and illegally harvested living aquatic resources or without such and on officials - from 510 UAH. up to 850 UAH. with the confiscation of instruments and means of offense, which are the private property of the infringer, and illegally harvested living aquatic resources or without such. Violation of procedure for acquisition or sale of fish under part 1 of article 88-1 of the Cao shall entail the imposition of a fine on citizens from 510 to 1700 UAH. with confiscation of objects of fauna or without such. However, in addition to administrative responsibility for violation of rules of fishing in the spawning period, there is also criminal liability for causing significant harm to fish stocks. According to article 249 of the criminal code of Ukraine provides for a fine in the amount of 1700 UAH. to 6800 UAH. or restraint of liberty for a term up to three years, or imprisonment for the same term, with confiscation of guns and fishing tools and all produced. According to the approved tariffs for calculating the amount of compensation for each illegally caught fish will be awarded the damages that should be paid to the local budget at the place of Commission of the offense, and it may be of 17 hryvnia for one copy up to 2550 UAH.
